CDC issues federal eviction moratorium through the end of 2020
Posted Sept. 3, 2020
The Centers for Disease Control and Prevention announced a temporary eviction moratorium to prevent the further spread of COVID-19. Under the order, landlords and property owners are prohibited from evicting certain tenants impacted by COVID-19, or face high fines.
The moratorium applies only to nonpayment of rent, and will not apply to residents who engage in criminal activity, threaten the health or safety of other residents, damage the property or violate their lease, other than for rent nonpayment. The order does not forgive rent or prohibit landlords or property owners from charging late fees.
To stop evictions, health officials are relying on the 1944 Public Health Service Act, which gives the administration broad quarantine powers. The moratorium, which will run through Dec. 31, applies to individuals earning less than $99,000 a year and who are unable to make rent or housing payments.
The new moratorium seeks to cover families experiencing financial hardship as a result of the pandemic, aiming to help as many as 40 million Americans who are already struggling to pay their monthly housing costs in the midst of the worst economic crisis since the Great Depression.
